Slobodzian and Mark Fazlollah INQUIRER STAFF WRITERS An FBI agent identified a Philadelphia college student yesterday as the masked gunman who stood over three prostrate bank employees during a 1995 Wisconsin bank robbery allegedly planned and executed by a group of white supremacists. Michael William Brescia also ``terrorized'' customers by igniting a smoke bomb in the bank lobby to cover his escape with two other robbers, FBI agent Paul Hendrickson Jr. told U.S. Magistrate Peter B. Scuderi. Despite Hendrickson's testimony about Brescia's alleged involvement in the Aug. 30, 1995 robbery of the Bank One branch in Madison, Wis., and Brescia's alleged creation of false identification documents, Scuderi rejected the prosecution request that the 24-year-old Andorra resident be held without bail pending trial. Scuderi noted that bank surveillance video described by Hendrickson depicts robbers wearing masks. The only evidence linking Brescia to that tape, Scuderi said, was the testimony of alleged co-conspirator Kevin William McCarthy. Scuderi added that Brescia had no prior criminal record and that his parents were willing to put their home on the line to underwrite his $200,000 bail. ************************************* JDT Commentary: "No prior criminal record" true enough. Assistant U.S. Attorney Michael Schwartz immediately obtained a stay of the bail order and arranged for an appeal hearing before U.S. District Judge Ronald L. Buckwalter. Brescia represented a threat to the community, Schwartz told Buckwalter, because there was no way to ensure that he might not obtain weapons and was a possible flight risk because he allegedly created false identification documents as part of the robbery conspiracy.
