JOHN DOE #2 IDENTIFIED; BUT CAN WE GET THE FBI TO ARREST HIM?

NOTE: 1ACR has been assisting Glenn & Kathy Wilburn with their private investigation of the Oklahoma City bombing and the search for ALL of the killers of their two grandchildren and 166 other Americans. The analysis below is my own, and it should be made clear that I do not presume to speak for the Wilburns. The Wilburns are two very courageous Americans who have suffered much in their search for the truth. Other Oklahoma City victims have criticized the Wilburns for seeking to get McVeigh off the hook. Nothing could be further from the truth. None of the information that they or their many volunteer helpers have discovered (of which I am but one) exculpates Timothy McVeigh. McVeigh was the truck driver, and a key player in the plot. What we are after is the rest of the bombers and the murdering bastards that sent them and sheltered them after the fact.

FBI SEZ WITH A VACANT STARE: "JOHN DOE WHO?"

IN THIS ISSUE:

"THE PHILADELPHIA STORY" DELAYED: McCARTHY'S PLEA AGREEMENT HEARING POSTPONED UNTIL 21 FEB

BUT THEN AGAIN, MAYBE NOT: OUR MIKEY BRESCIA "UNWANTED" POSTER (coming soon to a neighborhood near him).....

AND, J.D. CASH REPORTS FEDS ORDERED TO IGNORE SUSPECTS OTHER THAN McVEIGH-NICHOLS "PARTY LINE".....

AND, TULSA GETS INTERESTING....

AND, LANGAN JURY PICKED-- HE'S SCREWED....

**McCARTHY PLEA AGREEMENT HEARING POSTPONED AT PROSECUTOR'S DESPERATE REQUEST UNTIL 21 FEBRUARY. HEAT OFF BRESCIA, AGAIN...

The headline sez it all.

**SO WE ISSUE OUR MIKEY "JOHN DOE #2" BRESCIA "UNWANTED" POSTER......

The following 11x14 poster has been faxed to all the finer media outlets, militia contact points, private investigator hangouts, attorneys with terrorist clients and relevant FBI offices (including Philadelphia and Oklahoma City) around the country today:

"UNWANTED"
"By the FBI"
"MICHAEL BRESCIA"
"aka "John Doe #2"
(Mike Brescia's bad-haircut-college-fraternity-picture side-by-side with original FBI "John Doe #2" sketch)
"Unwanted for questioning, though suspected of:"
"Bank Robbery, Bombing, Murder & Mass Murder."
(Then text as follows):

"Mr. Brescia, currently residing at 859 Manatawna Avenue, Philadelphia, PA 19128, is a white supremacist neo-Nazi and at the time of the Oklahoma City bombing was a resident of Elohim City, a "Christian Identity" "racialist" compound in Oklahoma that has been linked in press accounts to Timothy McVeigh. According to testimony in federal court in Des Moines, Iowa, a member of the "Aryan Republican Army" bank robbery gang also came from Elohim City. (Although his name was forbidden by federal prosecutors to be mentioned in open court, the stated bank robber was later identified in the press as Mr. Brescia.)"

"Timothy McVeigh, Michael Fortier, Mr. Brescia and Brescia's roommate at Elohim City, Andreas Carl Strassmeir (a former German army officer mentioned in press reports as an ATF informant at the time of the Oklahoma City bombing) have all been named as material witnesses and/or probable perpretrators of the bombing in a civil suit by Edye Smith of Oklahoma City, who lost two young sons in the bombing. U.S. and Canadian press accounts have described witnesses who place McVeigh, Strassmeir and Brescia together just prior to the bombing. Other witnesses have picked out Mr. Brescia's photo as "John Doe #2", McVeigh's long-sought accomplice to the bombing."

"Also, Mr. Brescia and Mr. Strassmeir have been mentioned in press accounts in connection with the abduction and triple murder of a family in Arkansas that also seems to be related to the OKC bombing."

"Despite this, Mr. Brescia continues to walk the streets of Philadelphia unsought, unquestioned and undicted of any crime, while his co-conspirators in the bank robberies are all currently in jail, convicted or awaiting trial. WHY? Only the FBI, the Justice Department and the Clinton Administration know for sure. Ask THEM. Don't ask Mike Brescia; he's armed, dangerous and on a free pass from the FBI."

"Questions about this informational poster may be directed to Mike Vanderboegh, Editor, The John Doe Times, P.O. Box 926, Pinson, AL 35126"

END OF POSTER TEXT

Copies of this poster will be distributed across the country to the "various and sundry" (including 859 Manatawna Avenue) by volunteers in the coming days and weeks remaining of 1996. Anyone wishing to assist in the distribution of the poster, or merely to obtain one as a collector's item, may get a xeroxable copy of same by writing us at the P.O. Box and enclosing a SASE. (.32 postage, please.)

Printed on long-lasting, industrial grade white paper, they make great Christmas gifts for the hard-to-please federal law enforcement agent, FBI Director, U.S. Assistant Attorney or neoNazi terrorist, whether he's behind bars or running free. "Suitable for framing!" said John Cash, redoubtable reporter for the McCurtain Gazette, after viewing a pre-publication copy. "Send me three or four," he requested. They are already winging their way via postal turtle to Oklahoma.

After sending this modest effort to an "Up East" reporter, he asked me with the incredulity of the cynical, "Why are you doing this?"

"The poster, you mean? The John Doe Times? Or all of it?" I asked for clarification. It was indeed the larger question that vexed him.

I sensed that he just couldn't see my "angle." I wasn't getting paid for "this" certainly. He was perplexed that someone would knowingly make enemies with both the dangerously demented and the dangerously powerful: nazis, feds and God-knows-who-all-else.

I told him I was reminded of the line in Casablanca when the Resistance leader is asked the same question and he responds, "You might as well question why we breathe." This answer was either too indirect or obscure for him. "Why?" he persisted. I started off with stock answers about citizenship and justice, but it sounded stuffy and I caught myself.

"Look," I said, "You want to know why I did this poster? This Christmas, next week, there's 168 American families more or less that are going to gather around the Christmas tree for the second Christmas in a row without a loved one.. a father, a mother, a child. Meanwhile, in Philadelphia, that Nazi-terrorist-bastard-Brescia's going to be sitting around the parlor, all fireplace, hearth and home with HIS family and his gal-pal Esther Millar, having lost nothing so far but inconvenience, opening presents and laughing, and having a high old time. And why? All because the Clinton Administration and it's law enforcement arms find it too embarrassing to admit the truth about Brescia, John Doe #2 and Oklahoma City. It's beyond disgusting. THAT'S why I did the poster. If I can spoil that criminal's Christmas, and embarrass the federal agents that go slow and look the other way, I'll be happy to do it."

It IS about citizenship and justice and just simply breathing free, but I find that it is also increasingly getting personal for me. It ain't quite Ahab and the Whale, or Holmes and Moriarty yet, but it could get that way. With friends like Glenn and Kathy Wilburn it's hard not to let it get personal. It started out personal for them. Maybe every great struggle for justice and liberty is like that. For some, it starts out about a principle, and gets personal. For others, it starts out personal and ends up about a principle.

We owe our present mess to the sad fact that not enough Americans have considered the present government's actions to be contrary to their own (and the Founders') principles nor to be against their own personal self-interest. At places such as Waco, Ruby Ridge and Oklahoma City, we see the butcher's bill for such inattention to the basics of citizenship.

I will not apologize for taking my citizenship duties too seriously, when too many others take them too lightly, or not at all. If Brescia feels I've made a mis-statement of fact in this poster, or in any issue of The John Doe Times, he is free to sue me for slander or libel. He won't.

** J.D. CASH EXPOSES FED INACTION: "JOHN DOE WHO?"

McCurtain Gazette

19 December 1996

By John Cash

Federal Bureau of Investigation agents have been ordered not to send Denver prosecutors any information on new suspects in the Oklahoma City bombing that last year killed 168 people, the McCurtain Gazette has learned.

A spokeman for prosecutors in Denver flatly denies the report.

However, confidential sources close to the investigation have told this newspaper that remaining agents assigned to the bombing investigation have been ordered to cease sending Denver any further information on any suspects other than Timothy McVeigh and Terry Nichols.

Leesa Brown, spokesman for the Denver U.S. Attorney's office, says that's not the case. She also emphasized that the $2 million reward for information leading to conviction of other suspects is still on the table.

An Oklahoma City certified public accountant and grandfather of two children slain in the bombing was incensed by the news.

"It is absolutely incredible that they (Justice Department officials) are being so blatant about this obvious cover-up," said Glenn Wilburn. "There are over a dozen witnesses I have personally interviewed who said they told the FBI McVeigh was with other men that morning in Oklahoma City...clerly the government has something to hide and they don't want us to know who those others are."

Last summer, a federal grand jury charged with investigating the "Patriot's Day" attack, indicted Timothy James McVeigh, 28, and Terry Nichols, 41, and "others unknown" for their roles in this nation's most brutal act of domestic terrorism.

One member of that grand jury, Hoppy Heidelberg, was subsequently removed from the panel when he publicly accused federal prosecutors of trying to "shield" grand jury members from evidence as to who those "others" might be.

"They tried to make John Doe #2 disappear," Heidelberg said, adding, "John Doe #2 is obviously a government agent or informant and the government can't afford for that to come out because it would prove they had prior knowledge of the bombing and failed to stop it."

Heidelberg, who also called the federal investigation a "hoax," received a written warning from the judge in charge of the grand jury, admonishoing the Blanchard horse breeder from making any further statements which might violate the oath of secrecy taken by members of the panel when they were sworn in.

Also in Denver today, more depositions from employees of the FBI crime lab are scheduled.

Two more witnesses are to be deposed by members of the prosecution and defense teams concerning allegations that evidence was tainted in the Oklahoma City bombing case as a result of tampering and/or mishandling by bureau employees.

Timothy McVeigh's trial is set to begin March 31. No trial date has been set for the other defendant, Terry Nichols.

BOMBING TARGETS ALLEGED

Telephone Message Detailed at Hearing

By David Harper, World Staff Writer

A list and pictures of potential federal office bomb targets were introduced Wednesday at the preliminary hearing of a Tulsa man who is accused of relaying a threat to bomb 15 U.S. cities, including Tulsa.

In federal court testimony Wednesday in Tulsa, FBI agent Pete Rickel said searches Friday at the residence of James Dodson Viefhaus Jr. found ammonium nitrate and other chemicals that could be used in bomb making. The search also found a how-to book about constructing homemade weapons, a list of 18 mostly federal alleged targets and pictures of two Tulsa buildings-- Pratt Tower and the Meridian Tower-- that house federal agencies, Rickel said.

Also reportedly found was a picture of Viefhaus and his housemate, Carol Howe, holding weapons and wearing swastikas on their clothing.

Assistant U.S. Attorney Ken Snoke told U.S. Magistrate Frank McCarthy that the evidence seems to suggest Howe is "almost an equal threat" to Viefhaus. But she has not been charged in the case.

Story continues.....

Howe's car reportedly bore a National Socialist Alliance of Oklahoma bumper sticker.

Viefhaus was arrested after a caller from Seattle alerted FBI headquarters in Washington, D.C. about a menacing message emanating from a 918-area code telephone. That message was traced to a phone at 2422 South 126th east Ave., which is identified in court records as being the residence of Viefhaus and Howe.

According to an affidavit, this is a number that, when dialed, reaches a machine that provides the caller with a prerecorded message of the National Socialist Alliance of Oklahoma.

The message reportedly included references to a "holy war" with an "Aryan" agenda. It contained the statement "a letter from a high-ranking revolutionary commander has been written and received, demanding that action be taken by all white warriors by Dec. 15, and if the action is not taken, bombs will be activated in 15 pre-selected major U.S. cities."

The speaker also endorsed the April 1995 Oklahoma City bombing, which killed 168 people and injured more than 500 others. The speaker also supposedly referred to the federal government as the Zionist Occupied Government, or ZOG, which Rickel said is a term often used by white supremacists.

Rickel said Viefhaus admitted Friday that his was the voice on the tape. Viefhaus was arrested Friday night.

While Rickel was on the stand, in an effort to establish a broader conspiracy, hearsay evidence was introduced from a cab driver who reportedly gave a ride to a man who identified himself as being associated with the National Socialist Alliance of Oklahoma.

The fare supposedly mentioned the alleged bombing scheme, used a racial slur and claimed that the group was responsible for the murders of some black people whose deaths were supposedly chalked up by police as drug-related crimes. The person also reportedly said the group was targeting white women who were married to black men.

The cab driver, who Rickel said has been a reliable informant in the past, said the passenger indicated that Tulsa "may be" one of the cities singled out for bombing. The driver then dropped the man off at a "skinhead" party at a Tulsa motel.

Viefhaus did not appear in Federal Court until Monday, which defense attorney Craig Bryant said was a violation of Viefhaus' Fourth Amendment rights against unreasonable seizure.

Testimony Wednesday indicated that the U.S. Attorney's office does have a policy that normally puts the newly detained in front of a U.S. magistrate within 48 hours of arrest.

But McCarthy denied Bryant's motion to dismiss the criminal complaint for making a bomb threat, saying, that the delay was so small that dismissal would be too harsh a remedy, particularly in light of the circumstances.

Bryant pointed out that the specific language of the recorded message is not a direct threat, but merely a statement of what is in a supposed letter. Bryant said there is no evidence that Viefhaus ever personally threatened anyone. Bryant also said his client had a clean record, except for traffic offenses, and had not been charged with any firearms charges following Friday's searches.

Bryant also asked that his client be released into the custody of his grandmother, and the U.S. Attorney's Office also asked that Viefhaus be released on bond.

But U.S. probation officers urged that Viefhaus be detained pending further court dates, and McCarthy appeared stunned that the U.S. Attorney's Office wanted Viefhaus released from jail.

McCarthy said, "In light of recent history, not only in Oklahoma City but also with the World Trade Center bombing, it is absolutely inconceivable to me" that the U.S. Attorney's office would endorse Viefhaus' release from custody.

McCarthy said Viefhaus alleged statements appeared not to be "idle chatter at a social occasion." He said anyone who takes the trouble to put together a list of buildings to be bombed and keeps pictures of the exteriors of some of those buildings would appear to be serious about their intent.

**LANGAN JURY SELECTED: HE'S SCREWED.

COLUMBUS (OHIO) DISPATCH

18 December 1996

JURY SET FOR ACCUSED LEADER OF BANK BANDITS

Jurors likely will hear about the white supremacist beliefs of the Midwestern Bank Bandits.

By Robert Ruth, Dispatch Staff Reporter.

A black man is among 12 U.S. District Court jurors who are to decide the case against white supremacist Peter K. Langan, an accused leader of the Midwestern Bank Bandits.

**********************************

Transcriber's Note: Hoo boy, Langan's screwed! Time to deal if you can.

**********************************

STORY RESUMES.....

The other 11 jurors are three white men and eight white women. Two days of jury selection before Judge John D. Holscuh ended yesterday.

After yesterday's hearing, Kevin Durkin, one of Langan's attorneys, refused to comment on the racial makeup of the panel. However, he said, "Peter is convinced this jury is going to give him a fair trial."

Unlike the trial last month of another accused member of the bank robbery gang, jurors in Columbus are expected to hear testimony about the Bank Bandits' white supremacist and anti-Semitic beliefs.

Holschuh told prospective jurors Monday to expect such testimony.

A federal judge in Iowa in November barred any reference to the gang's racist beliefs in the trial of Scott A. Stedeford, a 28-year-old member of the gang who was convicted of three bank-robbery related counts involving a 1995 heist in West Des Moines.

But Durkin said during a pretrial hearing last week that the defense does not object to having the government present some testimony about white supremacist, neo-Nazi views.

Durkin warned, however, that he probably will cross-examine two government witnesses--- Kevin McCarthy, 19, and Shawn Kenney--- about their own anti-government, white supremacist beliefs as a way of challenging their credibility.

McCarthy was a former member of the gang who has pleaded guilty to three bank robbery-related charges. In pre-trial testimony, he acknowledged once holding anti-black beliefs. McCarthy also has admitted to frequently visiting Elohim City, a neo-Nazi compound in eastern Oklahoma.

Kenney was a friend of Langan's and shared his racist views, according to pre-trial testimony. Also, Kenney accompanied Langan and another gang member-- the late Richard Lee guthrie Jr.-- when they cased a bank near Cincinnati and armored cars in Arkanasas, according to pretrial testimony.

During questioning of potential jurors yesterday, Assistant U.S. Attorney Robyn Jones indicated that Kenney has been granted immunity from prosecution in exchange for his testimony.

The government in pretrial motions contends that one of the main reasons the gang robbed banks in Ohio and six other states in 1994 and 1995 was to raise money for a neo-Nazi, white supremacist group.

In an interview with reporters shortly after his arrest, Langan said he was a founder of the Aryan Republican Army, a white-supremacist revolutionary group.

Langan was arrrested Jan. 18 behind 585 Reinhard on the South Side after a brief shootout with agents,

His trial, scheduled to begin Jan. 8, involves two 1994 bank robberies in Columbus and Springdale, Ohio. He is expected to stand trial later on charges of robbing other banks in other states.
