Oklahoma County District Attorney Robert Macy has been talking a good game to the OKC survivors of late, but his actions have belied his words. He has previously stated his reluctance with the words-- "I don't want to open up another can of worms." One wonders what he has to be fearful of. Governor Keating? The Feds? Both of those parties have something to hide in this and would be greatly relieved if the Appeals Court ruled against the Wilburn-Key lawsuit to open a local grand jury investigation. See below. TULSA WORLD 5 DECEMBER 1996 "LEGALITY OF BOMB GRAND JURY DENIAL ARGUED" "Appeals Court Mulls Whether A State Panel Should Have Investigated The Attack." By Julie DelCour, World Staff Writer A year ago, an Oklahoma County district judge "just said no" to State Rep. Charles Key's push to empanel a state grand jury to investigate the Murrah Building bombing. On Wednesday, an appeals court panel reviewing Judge Daniel Owens' decision heard attorneys argue whether that denial was just and, more significantly, if it was legal. For nearly an hour, bombing victims, militia supporters, reporters and law clerks crowded together inside the seldom-used courtroom of the Tulsa Division of the Oklahoma Court of Appeals. Spectators, including ex-federal bombing grand juror Hoppy Heidelberg, heard lawyers for Key, R-Oklahoma City, and for Owens each deliver 15 minutes of oral arguments. Then, they heard them peppered with questions by Judges Daniel Boudreau, Jerry Goodman and Ronald Stubblefield. The panel, which will issue a written opinion, took the appeal under advisement. Beverly Palmer, an Oklahoma County district attorney representing Judge Owens, said Owens had rightly determined that Key's petition should not be circulated. The petition, she said, was legally insufficient and Key's allegations were too broad. Palmer said Owens also ruled that a federal grand jury with vast resources already was investigating the case and there was no need for a state panel to duplicate effort. Quoting from Owen's order, Palmer said Key was trying to "reinvent the wheel." There were reasons of public policy and judicial economy for denying Key's petition. "The court has to look at what the people of Oklahoma want; that's an important right," Palmer argued. But, she said, the calling of a grand jury "shouldn't be used at any whim." "Would you please identify these enormous public policy concerns?" Boudreau asked. Palmer said millions of dollars had spent on the federal investigation, and that a state grand jury might interfere with the federal case. She said a gag order in the federal case would prevent "us from interviewing witnesses." Mark Sanford, representing Key, said Owens' statement that Key was trying to "reinvent the wheel" was incorrect. "We, as representatives of the people, were asking for the opportunity to fill in the missing spokes of the wheel," Sanford said. He said there was no federal gag order in effect when Key was trying to get the state probe off the ground. "I don't think there would have been a problem of interviewing people that the federal grand jury had never talked to. The (state) grand jury is in secret anyway, so there would be no effect on the federal case 650 miles away in Denver." Stubblefield asked Palmer where Owens' order addressed the issue of legal sufficiency and if Key had to "name names" to make the petition specific enough to pass muster. The petition "talks about the investigation of a crime," Stubblefield said. "What more can they say?" Stubblefield also asked what evidence Owens relied on in making his decision, because he held no trial or hearing. "Judges have to be given facts. Was there anything he could have taken judicial notice of? Has he ever seen the federal indictment? Does he have to make a decision in a vacuum?" Palmer said that Key could have requested help from a state grand jury in sessions at the time, or the federal grand jury. Sanford said that Oklahoma County District Attorney Robert Macy had discouraged Key from bringing the bombing up with the state grand jury then in session, because it was looking into other matters. "We knew we couldn't get to the federal grand jury, because you can't contact it." Stubblefield said that Key's group perhaps should have approached another grand jury. "But are they legally required to?" He said of grand juries, whether "you like them or hate them, the right to call them is protected." After the hearing Wednesday, Key, an outspoken critic of the federal investigation into the April 19, 1995, bombing, said he thought the hearing at the State Office Building went well. "The law clearly is on our side," he said. In an earlier statement, Key said, "In this case, those who are covering up the Oklahoma City bombing appear to be the federal government itself." Heidelberg, a Blanchard horse breeder who was kicked off the U.S. District Court grand jury panel for violating his secrecy oath, said, "I don't have time to wait on them (appeals panel). The trail is getting cold." Heidelberg said he will ask a common-law court to hold a special grand jury. Heidelberg was dismissed from the federal panel shortly after it indicted Timothy McVeigh and Terry Nichols on murder and conspiracy charges. Heidelberg said that "all attempts to work within the (conventional) judicial system have been unfruitful and that no alternative seems to exist but to appeal to the people and their court of last resort, the Common Law Court." Key said he was willing to wait on a decision by the three-judge panel. Key pushed for the state grand jury investigation, along with Glenn Wilburn, the stepfather of Edye Smith, who lost two young children in the blast. Key said that if the panel rules in his favor, the push to get a state grand jury will be overdue but not unwanted. "The victims deserve to have the truth out, whether it is now or if it's next year. They don't want to live their lives wondering." He said the U.S. District Court grand jury that investigated the explosion didn't go far enough in seeking the identity of others who may have been involved. For instance, the identity of John Doe #2, allegedly seen by witnesses with McVeigh and near the Alfred P. Murrah building, remains unsolved even as McVeigh heads for trial in Denver on March 31, 1997, Key said. END OF STORY. CRUISING "COMMANDER PEDRO'S" OLD STOMPIN' GROUNDS OR, "WHERE ELSE WOULD A NEO-NAZI HANG OUT IN COLUMBUS, OHIO BESIDES 'GERMAN VILLAGE?'" 585 Reinhard Avenue, the not-so-safe-house of the Aryan Republican Army (behind which the FBI demonstrated last January the appalling depths to which it's marksmanship program has declined in recent years during the Langan "arrest" or "assassination attempt"-- take your pick), is located at the seedy, southeast edge of one of the older sections of Columbus: German Village. I mean, where else would a neoNazi hang but in "German" Village, a neighborhood built on beer-und-brats but given over in more recent years to upscale homosexual tenants (shades of Ernst Roehm!)? Thanksgiving week I traveled to Columbus, erstwhile "Cowtown", "Pimple on the Prairie" and home, it is said, of an obscure football team of some past glory (as someone born in Michigan but raised from a young age amongst the heathen Buckeye, I was uniquely qualified for the task) to visit 585 Reinhard, talk to the unsuspecting townsmen of Commander Pedro and peruse some very interesting court documents (and audio and video tapes) at the Federal Court House on Marconi. 585 is in the process of complete "rehab" following a fire on the second story, which occured sometime after Commandant Pete was relieved to find himself still alive post-shoot out (if a completely one-sided exchange of copper-jackets can be called a "shoot-out", perhaps "shoot-up" is more accurate). The "rehabbers" were in full swing when we pulled up at the scene of the "shoot up". They were of course well aware of the famed past tenants, the shoot-up fast becoming a subject of lore and fable in the neighborhood. My crackerjack team fanned out across the area, passing out pictures of Mikey Brescia/John Doe #2 ("Have You Seen this Man?") and seeking details of Commander Pedro and the Lost Planet Aryans. Most of the neighbors we spoke to who were witnesses to the shoot-up thought, like Langan himself, that the FBI was trying to kill him, not arrest him. One exception to that was a fellow we found out working in his garage, who had adopted the theory that since the FBI shot "all around" Langan but did not seriously wound him that they did not wish him terminal illness. After all, he explained, weren't the FBI some of the best marksmen in the world? J. Edgar, I thought, must be rolling in his grave. I had my photo taken standing on the porch of 585, as I intend to send some Christmas cards this year. We then proceeded to cruise neighborhood businesses (especially the bars) with our little Mikey Brescia fliers (we had no hits on John Doe #2, it was a long-shot going in and we knew it-- but there was an outside chance Brescia could have stopped off there on his way back to Philly, so we made the effort. We may yet see some results on John Doe #2 from the contacts we made.) Too bad we had left our Esther Millar photos at home, she is MUCH more memorable a figure than Mikey. So we had a fine blustery afternoon, talking to the neighbors, used furniture salesmen, gas jockeys, barmaids and other folks who were able to pick Commander Pete out of a photo lineup. We got some promising leads, and a couple of curious tidbits about Langan which deserve further exploration. Of course, we also drew a few "Go aways" and one "Get the f-ck off my my porch, asshole," from behind firmly locked, barred and curtained doors. But on the whole the citizenry were quite cooperative when we told them we were there because of Oklahoma City. A very productive trip, all in all. In the Federal Court House, we dubbed a copy of "The Aryan Republican Army Presents: The Armed Struggle Underground" videotape produced by the ARA for the folks back home (it was seized in an envelope with Aryan Nations "Pastor" Richard Butler's Hayden lake address on it). The tape, made at the Pittsburg, Kansas safehouse during January, 1995, is alternately hysterically funny, unintentionally revealing and (to the uninitiated), mostly boring. It didn't lose my interest, although as "underground" tapes go, this one was definitely lacking in production values. Guthrie/"Commander Pavel" (garbed alternately in gasmask, ski mask and halloween mask and hardhat), in particular, could have benefited from a non-repetitive script and a director with any sense whatsoever of the "less-is-more". (You know, I bet my momma never figured that one day I'd grow up to be a critic of neo-Nazi terrorist films. It just goes to show you that in America, you can be anything you aspire to.) Upon my return, copies of the tape (and some critical documents) were soon winging their way around the country, including the one that Ambrose Evans-Pritchard used as the basis for his attached story. The Langan case documents were even more interesting, and revealing, than the tape. I came away with the serial number and description of every firearm that was seized from the gang, plus the VIN numbers of every vehicle, phone calling card numbers, descriptions of the many, professional fake IDs they had, and list after list of property inventories, and a few very interesting court motions and evidence submitted to support those motions. One of those documents was the piece of paper that I believe killed Richard Guthrie. THE PAPER THAT KILLED RICHARD GUTHRIE Regular readers of The John Doe Times (and it's predecessor "John Doe #2 Identified, But Can We Get The FBI To Arrest Him?") will recall that Langan's long-time friend and bank-robbing pardner Richard Guthrie was found dead in his Covington, Kentucky jail cell about 6:00 am Eastern, 12 July 1996. He was hanging from a heating duct by a dirty bedsheet. Immediately prior to his "suicide", Mr. Guthrie had made a deal with the FBI & U.S. prosecutors to testify against Mr. Langan and others in the ARA in return for reduced sentence AND had spoken by phone with an LA Times reporter the day before about the book he was going to write about the real inside story of the bank robbers and their friends-- and about the U.S. government. "You won't believe what I can tell you," he is reported to have said. Yes, on Thursday, 11 July, things were really looking up for Richard Guthrie. Also, on that same day, the following order was issued in the Langan case. When I found it filed in the court documents in Columbus the Friday after Thanksgiving, I got a chill feeling, and it wasn't from the drafty courthouse. Worth noting is this entry from the Criminal Docket (or list of motions and orders for the case): "7/11/96 (Event) 100 Document Sealed (pursuant to Court Order) (pl) (Entry date 07/11/96)." This notation immediately preceeds that of Guthrie's Writ Ad Testificandum in the docket. These were the only two events noted for the date 11 July. What is in the sealed document that relates to Guthrie? We won't know until Langan's trial is over. A couple lines down is this notation: "7/12/96 -- Writ issued as to Richard Guthrie returned - deceased. (pl) (Entry date 07/12/96)." This writ commanded on Thursday that Guthrie be transported to Columbus for a hearing on Monday, the first chance he would have to testify before someone other than an FBI agent or U.S. attorney. If he had something to tell, it presumably could have been asked of him during this pretrial hearing, on the record, under oath. He was dead before sunup on Friday. Faced with the prospect of "ratting out" his childhood buddy Langan to his friend's face, did Guthrie kill himself out of remorse for having rolled over? Or did someone "Arkancide" him to keep the only other member of the gang besides Langan who had been in it since the beginning from talking about some of the other persons and issues involved? Whatever the answer to that larger question, this writ was the piece of paper that killed Richard Guthrie. The armed assaults were allegedly carried out by members of the Aryan Army - wearing Ronald Reagan and Count Dracula masks - to fund their revolutionary activitie= s. =0D Three men are being prosecuted for the robberies and possession of explosives. Commander Pedro warned that all blacks would be deported from the "Aryan Republic". The pro-IRA sympathies of these neo-Nazis are a new twist in the story = of the American racist Right. The Ku Klux Klan used to be virulently anti-Catholic, but many of the members of the Aryan Republican Army are from middle-class Catholic backgrounds. =0D Mark Thomas, allegedly the intellectual mentor of the Aryan= Republican Army, says that he identifies with the "anti-colonial" struggle of the IRA. "I am no Catholic, but= my prayers are with the IRA," he wrote in his publication, The= Watchman. "The Hard Men who lead them are the mighty of our race . . . May God bless them and keep them. Sinn Fein.= Hail the IRA!" = =0D It is an astonishing position for a man who was once a "sta= te chaplain" of the Ku Klux Klan. (He is now Pennsylvania director of the Aryan Nations, a successor to the fascist "Silver Shirts" of the 1930s that looks down on the KKK as "do-nothing belly-achers".) =0D Thomas is a follower of Nietzsche and the "ancestral memory" theories of Carl Jung. He has become a priest in th= e growing religion of "Christian Identity". The sect believes= that the European peoples are the lost tribes of Israel. He told= The Telegraph that the Celtic outposts of Scotland and Ireland = are the most pure of the Aryan peoples, as the last to succumb = to Judaic influences. =0D Commander Pedro is in fact Peter Langan, 38, a high-school drop-out from suburban Washington, whose father worked for the CIA. =0D He and his friends are clownish figures in many ways, but t= he Aryan Army cell was well-equipped for terrorism. The FBI captured a shoulder-fired rocket launcher, Semtex explosive= s, hand-grenade canisters, 11 pipe-bombs, and an arsenal of guns. "These people had a support system. They had safe-houses and very good false documents," said Mike Reynolds, senior intelligence analyst at the Southern Pover= ty Law Centre, which monitors Right-wing violence across the country. "They were clearly preparing for something beyond bank robberies." =0D What makes this Aryan Army cell so menacing is the growing body of evidence that its members were in contact with Tim McVeigh, the prime suspect in the bombing of the Oklahoma federal building in April last year. Two of the bank robber= s were residents of a Christian Identity compound in Oklahoma= named Elohim City. McVeigh telephoned Elohim minutes after reserving the truck allegedly used in the bombing. =0D Michael Brescia is believed to be a fifth member of the Ary= an Army cell. He also lived at Elohim City. Five women at a night club in Tulsa have identified Brescia as the man they= saw sitting with Tim McVeigh - and paying for the drinks - = on April 8, 1995, 11 days before the bombing. A mother and daughter in Kansas have told the FBI that they met Brescia = in the company of McVeigh several times. =0D Whether or not this link can be proved, one thing is clear:= the Aryan Republican Army is intent on mass violence.
